Terms of Service for UK Architectural Drawing Services

1. Introduction

By using our architectural drawing services, you (the “Client”) agree to the following Terms of Service (the “Agreement”). These terms govern the use of our services, which include the preparation of architectural plans, drawings, and related consultation.

2. Acceptance of Terms

By engaging our services, the Client confirms that they have read, understood, and agree to these Terms of Service. These terms apply to all services provided by us, including but not limited to consultations, design, and project work.

3. Scope of Services

We provide a range of architectural drawing services, which include:

  • Architectural Design: Creation of concept and final architectural drawings.
  • Planning Permission Drawings: Drawings that comply with the UK planning system for submission to local councils.
  • Permitted Development Drawings/Prior Approval/ Lawfulness Certificate/ Planning Permission.
  • Building Control Drawings: We can prepare drawings that meet the requirements for building regulations approval.

4. Client Responsibilities

The Client agrees to:

  • Provide us with all necessary information and details about the property to enable the creation of accurate drawings (e.g., existing drawings, estate agent plans, measured surveys etc.).
  • Approve or provide feedback on drawings and designs in a timely manner.
  • Ensure that the property details provided are accurate and up to date.
  • Ensure the drawings are used only for the purposes agreed upon (i.e., obtaining planning permission or building control approval).

5. Fees and Payment

  • Fees: All fees for architectural drawing services are as listed on our Shopify store or as otherwise agreed upon in writing. Additional charges may apply for revisions beyond the original scope or for services not initially agreed upon.
  • Payment Schedule: All services must be prepaid in full through Shopify prior to the commencement of any work. No work will begin until payment has been received.
  • Late Payments: Since services are prepaid, late payments are not applicable. However, if any additional agreed-upon services are invoiced separately, payment must be made within 10 days of invoice.

6. Revisions

  • Free Revisions: We offer 3 rounds of revisions at no additional charge.
  • Additional Revisions: After the free revisions are used, additional revisions may incur an extra fee, which will be agreed upon prior to work commencing.

7. Delivery of Drawings

  • Timescales: We will provide an estimated timeline for completion of the drawings based on the complexity of the project. However, timelines are subject to change depending on the scope and revisions required. We aim to deliver each project within 14 working days from the date payment is received and all necessary project information has been provided.
  • Approval: The Client is responsible for reviewing and approving the drawings. Once the Client approves the final drawings, they are considered final and any further changes may incur additional charges.

8. Planning Permission and Building Control Approvals

  • Planning Permission: While we provide the necessary drawings for planning permission applications, the Client is responsible for submitting these to the local council and obtaining approval.
  • Building Control Approval: The drawings we provide are intended to meet building control regulations; however, the Client is responsible for ensuring that the final design complies with all applicable local building codes and regulations. Additionally, the Client must ensure that structural design drawings—if required—are prepared by a qualified professional and submitted to the Local Authority as part of the building control application.

9. Intellectual Property

  • All drawings and designs provided are the intellectual property of My Extension Project. The Client is granted a license to use these materials only for the specific purposes of the project.
  • The Client may not copy, reproduce, or distribute the drawings for any purpose other than the project without written permission from us.

10. Confidentiality

We will treat all Client information as confidential and will not share or disclose any details regarding your project without your consent, except as required by law.

11. Limitation of Liability

While we make every reasonable effort to ensure that our drawings are accurate and align with UK planning and building regulations, we do not guarantee that planning permission or building control approval will be granted. Approval decisions are at the sole discretion of the relevant authorities and outside our control.

Our liability is strictly limited to the total fees paid by the Client for the specific services rendered. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or third-party claims.

The Client is responsible for reviewing and approving the final drawings before submission. We are not liable for any errors, omissions, or changes made to the drawings after delivery, or for the misuse of the drawings by the Client or any third party.

Nothing in this agreement limits liability for death or personal injury caused by negligence or any other liability which cannot be legally excluded.

12. Termination of Services

  • Either party may terminate the agreement by providing written notice to the other party. If the Client terminates the agreement after work has started, they will be required to pay for any work completed up to the point of termination.
  • If we terminate the agreement, we will refund any fees paid for services not rendered.

13. Dispute Resolution

In the event of a dispute, both parties agree to attempt to resolve the issue through negotiation. If a resolution cannot be reached, the dispute may be resolved through mediation or arbitration, as agreed by both parties.

14. Amendments to Terms of Service

We reserve the right to amend these Terms of Service at any time. Any changes will be communicated to the Client, and the updated terms will take effect upon posting on our website or via email.

15. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United Kingdom.
